Civil Remedies for Infringement
A civil remedy refers to the remedy that a party has to pay to the victim of a wrong he commits. A civil remedy is generally separate form a criminal remedy, although in certain situations the civil and criminal remedy may be related.
There are three kinds of remedies against infringement of copyright, namely:
- Civil remedies. Injunction damages or account of profit, delivery of infringing copy and damages for conversion.
- Criminal remedies. Imprisonment of the accused or imposition of fine or both. …
- Administrative remedies.
The minimum punishment for infringement of copyright is imprisonment for six months with the minimum fine of Rs. 50,000/-. In the case of a second and subsequent conviction the minimum punishment is imprisonment for one year and fine of Rs. one lakh.
